Turkish Employees-Expats -Ankara Agreement between Turkey and EU- the Association Council Decision No:1/80
The Association Council Decision No. 1/80 on free movement provides some opportunities to Turkish citizens and their family members in the employment markets of the member countries they are in.
According to this decision, as the working time of the citizens of the Republic of Turkey increases in the member country, their legal position also gets stronger.
Article 6
A Turkish citizen who enters the legal labor market of a Member State in accordance with the rules:
- After 1 year of legal work, the employer may extend the work and residence permit at the workplace of the same employer (if the employer wishes), provided that the employer also requests it.
- After 3 years of work, he/she can apply for all vacant jobs in the same industry and extend his/her residence permit.
- After 4 years of legal work, any paid employee in the member country can apply freely and extend their residence permit.
Dutch foreigners’ law grants Turkish citizens the right to apply freely and to extend their residence permit after 3 years of work in the member country where they have worked en resided.
